These terms and conditions apply to the XchangeTR app (hereby referred to as "Application") for mobile devices created by AHT Apps (hereby referred to as "Service Provider"), with basic features offered free of charge and additional features available through in-app purchases (subscriptions).
Important: Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.
User Declaration
By using the Application you expressly accept, declare and undertake the following:
- All information you provide during registration (e-mail, business details, location, etc.) is accurate, complete and up-to-date.
- Keeping your account credentials (password, etc.) secure is solely your responsibility. XchangeTR cannot be held liable for any damage arising from unauthorised use of your account.
- You may not share your account credentials with third parties or transfer your account to another person.
Intellectual Property Rights
Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted.
All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
Right to Modify
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason.
The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
Security and Responsibility
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application.
The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, and malicious programs, and may result in the Application not functioning correctly or at all.
Third-Party Services
The Application utilizes third-party services that have their own Terms and Conditions:
- Google Play Services
- Google Analytics for Firebase
- Firebase Crashlytics
- NosyAPI (Market data provider)
Internet Connection
Some functions of the Application require an active internet connection. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.
If you are using the application outside of a Wi-Fi area, your mobile network provider's agreement terms still apply. You accept responsibility for any charges, including roaming data charges if you use the application outside of your home territory without disabling data roaming.
Data Accuracy and Disclaimer
While the Service Provider strives to ensure that the application is updated and accurate at all times, they do rely on third parties to provide information.
This application is for information and market tracking purposes only. It is not investment advice.
The currency and gold prices shown in the application are for informational purposes only and do not constitute investment advice. Data is delayed by 15 minutes. We do not provide buying/selling recommendations for any financial instruments that require an SPK (Capital Markets Board of Turkey) license.
- Prices displayed may be updated with delay by shop owners or due to market conditions.
- Always verify prices directly with the shop before making a transaction.
- XchangeTR cannot be held liable for financial losses resulting from incorrect prices.
- XchangeTR is not responsible for the accuracy of prices, ratings or location data entered or confirmed by users. XchangeTR shall not be liable for any direct or indirect damages suffered by third parties as a result of relying on such user-generated content.
- Automatic Price Updates (Autopilot): This feature operates based on market data obtained from third-party data sources (API providers). XchangeTR cannot be held liable for incorrect price reflections caused by technical failures, delays or data errors from API providers.
- By using the automatic price update feature, business owners acknowledge that the responsibility to verify updated prices before reflecting them on their physical signage rests solely with them.
The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.
Business Listing and Removal Rights
To provide users with a business discovery service for currency exchange offices and jewelers, XchangeTR may list business information compiled from publicly available sources (trade registry, municipal license records, field research, etc.). Such listings consist solely of publicly available, non-copyrightable information such as business name, address and location; no third-party database references (e.g. Google Place ID) are stored.
- Claiming: Business owners listed on the platform may claim their business profile on XchangeTR to update and manage their information.
- Removal Request: Business owners may request removal of their listing from the platform without providing any reason by submitting a written request to [email protected]. Removal requests are processed within 72 hours.
- Legal Basis: Publicly available business information constitutes non-copyrightable public facts under the principle of publicity of the trade registry as stipulated by the Turkish Commercial Code and general law.
Age Requirement and Eligibility
To use this application, you must be at least 18 years old. By downloading or using the application, you declare that you are 18 years old or older.
- Individuals under 18 years of age cannot use this application without written consent from their parents or guardians.
- If you are under 18, your parents or guardians are responsible for reading and approving this agreement.
- If it is discovered that false age information was used to register, the account will be immediately closed.
Campaign Terms and Termination Rights
"First 50 Businesses" Campaign: XchangeTR offers 6 months of free Premium membership to the first 50 registered businesses at launch. Campaign terms are as follows:
- Campaign benefits apply only to businesses that comply with the terms of this agreement.
- System Abuse: If manipulation, false pricing, spam, misleading content submission, or illegal activities are detected, XchangeTR reserves the right to terminate membership without notice and without compensation.
- After the campaign period (6 months), Premium access will be suspended. Users may voluntarily switch to a standard paid plan if they wish. (For subscriptions initiated through app stores, the renewal rules of the respective store apply).
- Changes to campaign terms will be notified at least 30 days in advance.
Multiple Accounts and Account Suspension
Each user or business may only open one account. If a person or business is found to have created multiple accounts, all related accounts may be immediately suspended or deleted.
- XchangeTR reserves the right to suspend access or permanently terminate any account at any time, with or without cause and without prior notice.
- A banned or terminated user may not attempt to re-join the platform by creating a new account. Accounts identified as circumventing a ban will be immediately closed.
- To appeal an account suspension or termination, you may submit a written request to [email protected]; the final decision rests solely with XchangeTR management.
- Content contributed by a terminated user (price confirmations, reviews, etc.) may continue to be stored on the platform; removal of such content is at the sole discretion of XchangeTR.
Subscription, Cancellation and Refunds
Subscription: Paid plans are offered in monthly or annual periods. Subscriptions automatically renew at the end of the term unless canceled.
Cancellation: You can cancel your subscription through the following methods:
- From the My Account → Plan Management section within the app,
- From your App Store (Apple) or Google Play (Android) subscription settings,
- By sending an email to [email protected].
Cancellation becomes effective at the end of the current billing cycle; partial refunds are not provided for the remaining time.
Refund Policy: Under Turkish Law and applicable store (Apple/Google) policies;
- First-time subscribers may request a refund within 14 days of purchase provided the service has not been utilized.
- If an annual subscription is canceled within the first 30 days, a proportional refund will be evaluated.
- Refund requests should be directed to [email protected].
Free Trial: Provided free trial periods expire on the specified date; if not canceled beforehand, they will convert to a standard paid subscription.
Personal Data Retention, Deletion and Breach Notification
In accordance with KVKK (Turkish Personal Data Protection Law) and related legislation, your data retention periods are as follows:
- Terms Acceptance Records: 10 years. (Under the Turkish Code of Obligations and Turkish Commercial Code, within the scope of general statute of limitations periods, for legal dispute resolution and legal audit purposes)
- Consent Date and IP Address: 2 years. (Due to the obligation to retain traffic records pursuant to Law No. 5651 on Regulation of Publications on the Internet)
- Price and Location Data: As long as your account is active. (Processed for the duration necessary to provide the service; deleted or anonymized when your account is deleted unless relevant legislation requires otherwise)
Deletion Request: If you wish to delete your account and personal data, you can send an email to our support team ([email protected]). Your request will be processed as soon as possible and within the legal limit of at most 30 days (typically within 24 hours according to our internal principles).
Data Breach Notification: In accordance with Article 12 of KVKK, in the event of unauthorised access, disclosure or loss of personal data, the Service Provider shall notify the Personal Data Protection Authority (within 72 hours) and the affected users as soon as reasonably practicable. Notification will be sent via your registered email address or through an in-app notification.
Updates and Termination
The Service Provider may wish to update the application at some point. You will need to download the updates if you want to continue using the application.
The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.
Changes to Terms
The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Turkey. For the resolution of any disputes arising from this agreement, the Istanbul Anadolu Courts and Execution Offices shall have jurisdiction.
Users acting in the capacity of a consumer reserve the right to apply to the Consumer Arbitration Committee or Consumer Courts in their place of residence.
